Employers' Obligations

 What should I expect from my employer?

  1. Your employer should know if it needs to comply with FMLA. Generally, if it has 50 or more employees, then the company needs to comply and let you take your leave of absence.

  2. Your employer should be able to provide you written information about FMLA and any other state specific rights you have regarding a leave of absence.

  3. Your employer should have a process to document your request for leave.

  4. Your employer should have a process for administering your leave.

What if my employer does not help me understand my FMLA rights and leave rights, or has violated my rights?

  1. Learn your rights and self advocate. Start here.

  2. Document your request to your employer for yourself. For example, make sure to send an email to your manager or HR with your leave request.

  3. If applicable, file a complaint against your employer.
